Affiliate Program Policy

Welcome to the Lovall Affiliate Program! As an affiliate of Lovall, you will earn commissions on sales generated through your unique trackable discount code. This policy outlines the terms and conditions of participation to ensure a clear understanding of expectations, responsibilities, and the protection of both affiliates and Lovall’s brand.

 

1. Program Overview

Affiliates are independent partners who promote Lovall products using their personalised, trackable discount code. Affiliates earn a commission for every sale made through their unique code. The goal of the affiliate program is to foster a mutually beneficial relationship that allows both Lovall and our affiliates to grow.

 

2. Eligibility

To become an affiliate, you must:

• Be at least 18 years old.
• Have an active website, blog, social media presence, or other digital platform where you can promote Lovall.
• Submit an application to the Lovall Affiliate Program and receive approval.
• Comply with all terms set out in this policy.

Lovall reserves the right to approve or reject affiliate applications at its discretion.

 

3. Affiliates’ Responsibilities

Affiliates are expected to:

• Promote Lovall products: Affiliates must use their unique discount code to promote Lovall products via their own platforms (e.g., website, blog, social media, newsletters, etc.).
• Maintain transparency: Affiliates must disclose that they are earning commissions through affiliate links or discount codes, as required by law (e.g., using #ad or #affiliate on social media posts).
• Accurate Representation: Affiliates should not make false claims or misrepresent the Lovall brand, products, or services. This includes avoiding negative or misleading statements about our products or competitors.
• Channel-Specific Sales: Affiliates may only earn commissions on sales generated directly through their personal marketing channels. Using your unique discount code on unauthorised platforms, such as voucher websites or third-party discount sites, is prohibited.

4. Commission Structure

• Commission Rate: Affiliates will earn an agreed commission percentage on each sale made through their unique discount code.
• Tracking: All sales will be tracked through the affiliate’s unique discount code, which must be used by customers to qualify for commissions. Only sales where the discount code is entered at checkout will be eligible for commission.
• Payout: Commissions will be paid quarterly. Payments will be made via bank transfer.
• Commission from Authorised Channels Only: Affiliates will only receive commissions from sales generated via their direct marketing channels (e.g., personal website, social media, blog). Sales generated through unauthorised channels, such as voucher or coupon websites, will not qualify for commissions, with overpayments being reclaimed.

5. Prohibited Practices

Affiliates must not engage in the following prohibited activities:

• Voucher and Coupon Websites: Affiliates may not post or distribute their unique discount codes on third-party voucher or coupon websites. Any sales originating from these sites will not be eligible for commission, even if the affiliate did not directly post the code there.
• Fraudulent Transactions: Using or encouraging the use of fake or fraudulent orders to generate commissions is strictly prohibited.
• Spamming: Affiliates should not engage in spammy marketing practices, such as unsolicited emails or excessive messaging, to promote their codes.
• Misleading Marketing: Affiliates must not promote Lovall products in a misleading or deceptive manner, including offering false discounts or making unsubstantiated claims about the products.
• Brand Abuse: Affiliates may not use Lovall’s brand name, logo, or any other intellectual property in any paid ads, including but not limited to Google Ads, Facebook Ads, or similar platforms, without prior written approval.

6. Commission Reclamation

Lovall reserves the right to reclaim commissions from affiliates for any sales that are found to have been generated through unauthorised platforms or methods (e.g., voucher/coupon websites), even if the affiliate did not directly post their unique code on these platforms. If a sale is determined to be in violation of these policies, the amount of commission to be reclaimed will be determined at Lovall's discretion, based on our data sources.

• Invoice and Payment Terms: Once the reclaimed commission is calculated, Lovall will send an invoice to the affiliate for the amount owed. The affiliate must make payment within 7 days of receiving the invoice. If payment is not received within this period, the debt will accrue interest and be sent to a debt recovery facility. The affiliate’s participation in the program may also be suspended or terminated.

7. Affiliate Code Usage

• Affiliates will receive a unique trackable discount code upon approval into the program.
• This code must only be used for promotional purposes by the affiliate through their own approved channels. The code may not be resold or distributed in any unauthorised manner.
• Affiliates should ensure that their discount codes are not shared with fraudulent or inappropriate individuals or platforms.

8. Termination of Affiliate Status

Lovall reserves the right to terminate an affiliate's participation in the program at any time, for any of the following reasons:

• Violation of the Affiliate Program Policy.
• Engaging in fraudulent activities.
• Making misleading, harmful, or defamatory statements about Lovall.
• Posting discount codes on unauthorised platforms like voucher websites, even if done by third parties.
• Inactive participation in the program for a prolonged period (e.g., no sales or promotional activity for 6 months. Unless otherwise previously agreed upon with Lovall.

Affiliates may also voluntarily withdraw from the program at any time by notifying Lovall in writing.

 

9. Affiliate Tracking and Reporting

Lovall will provide affiliates with access to an affiliate dashboard, where they can track their sales, commissions, and performance. Affiliates should regularly check their dashboard to monitor progress and ensure all activity is being properly tracked.

 

10. Intellectual Property Rights

• Lovall Branding: Affiliates are granted a limited, non-exclusive, and non-transferable license to use Lovall’s name, logo, and other brand assets solely for the purpose of promoting the affiliate program, subject to Lovall’s approval.
• Ownership: All intellectual property rights to Lovall’s branding, products, and website remain the property of Lovall. Affiliates may not use or alter Lovall’s trademarks or materials beyond the scope of the program.

11. Privacy and Data Protection

• Customer Data: Affiliates must respect the privacy and confidentiality of customer data. You are prohibited from using or sharing any customer information outside the scope of your affiliate activities.
• Affiliate Information: Lovall may collect and process affiliate information for the purpose of managing the program, processing payments, and communicating relevant program updates.

12. Limitation of Liability

Lovall is not liable for any damages, losses, or expenses incurred by affiliates due to participation in the program. This includes, but is not limited to, issues arising from tracking errors, technical failures, or affiliate marketing activities.

 

13. Amendments

Lovall reserves the right to modify this policy at any time. Any changes will be communicated to affiliates, and affiliates will have the option to accept the new terms or withdraw from the program.

 

14. Legally Binding Agreement

By participating in the Lovall Affiliate Program, you acknowledge that you have read, understood, and agree to all the terms and conditions outlined in this Affiliate Program Policy. This agreement is legally binding and constitutes a contract between you (the affiliate) and Lovall.

You further acknowledge that any violation of these terms may result in the termination of your affiliate status, the reversal of commissions, and potential legal action. If any disputes arise under this agreement, they will be resolved in accordance with the laws of England and Wales.

By joining the Lovall Affiliate Program, affiliates acknowledge that they have read, understood, and agree to abide by the terms and conditions of this Affiliate Program Policy.
